Terms of Use & End User License Agreement
Welcome to Thermal Camera (the "App"), a mobile application developed and operated by Nergis Sadıklar ("we", "us", or "our").
By downloading, installing or using the App you agree to these Terms of Use ("Terms"). If you do not agree, please do not use the App.
1. What the App is — and is not
- No measurement. Nothing the App displays is a temperature reading, and no value it shows should be treated as one. The "hot" and "cold" crosshairs mark the brightest and darkest regions of the picture, not the warmest and coolest objects.
- Not a professional instrument. The App is not a substitute for a thermal imaging camera, a building inspection, an electrical survey, a medical device, a security system, or any other professional equipment or service.
- Do not rely on it for decisions. You must not use the App to diagnose illness, detect fever, check electrical or heating installations, find water damage or insulation faults, locate people or animals in an emergency, or make any other decision where being wrong carries a cost. We accept no liability for any loss, damage or injury arising from doing so.
- Entertainment and creativity. The App is intended for photography, video and creative effects.
2. Apple App Store terms
The App is licensed, not sold, to you. Your use is also subject to Apple's Apple Media Services Terms and Conditions and to Apple's standard Licensed Application End User License Agreement, except as expanded upon here.
These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
3. Subscription and payments
- What Pro unlocks. All 20 effects across the three modes, 4K video recording, capture without the watermark, and camera-roll import.
- Billing. Payment is charged to your Apple Account at confirmation of purchase. All payments are processed by Apple; we never handle your payment details.
- Free trial. Where a free trial is offered, any unused portion is forfeited when you purchase a subscription.
- Renewal. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Managing and cancelling. Manage or cancel your subscription in Settings > [your name] > Subscriptions on your device. Deleting the App does not cancel a subscription.
- Refunds. Refunds are handled by Apple through reportaproblem.apple.com. We cannot issue them.
4. Your content
Photos and videos you capture with the App are yours. They are stored on your device and we claim no rights over them. You are responsible for what you record, and for respecting the privacy, image rights and local laws that apply to the people and places you film.
5. Acceptable use
You agree not to use the App to harass, stalk or covertly record anyone, to break any law, or to present its output as a genuine thermal measurement to anyone else. You may not reverse engineer, decompile or attempt to extract the source code of the App, nor resell or redistribute it.
6. Intellectual property
The App — including its code, design, interface, palettes and graphics — is the property of Nergis Sadıklar and is protected by copyright and trademark law.
7. Disclaimer of warranties
The App is provided "as is" and "as available", without warranty of any kind to the maximum extent permitted by law. We do not warrant that it will be uninterrupted, error-free, or that its output will be accurate or fit for any particular purpose.
8. Limitation of liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits or data, arising out of your use of the App. Where liability cannot be excluded, it is limited to the amount you paid for the App in the twelve months before the claim.
Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.
9. Changes to the App and these Terms
We may add, change or remove features, and we may update these Terms. The "Effective" date above shows when they last changed. Continuing to use the App after a change means you accept the updated Terms.
10. Termination
You may stop using the App at any time by deleting it. We may suspend or terminate your licence if you materially breach these Terms.
11. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict of law rules. This does not deprive you of the protection of mandatory consumer law in your country of residence.
